Marlborough ZBA allows 22 Second Road addition to withdraw without prejudice

MARLBOROUGH — August 10, 2020 — Marlborough ZBA pushes 22 Second Road addition back to the drawing board over lot coverage. The Zoning Board of Appeals on Aug. 10 unanimously granted owner Tracy Rockwell and contractor Kevin Figueroa leave to withdraw without prejudice after members signaled they would reject a special permit that raised lot coverage from 32 percent to 37.2 percent against a 30 percent cap and brought the side setback to 9.1 feet. Member Robert Levine said neighbors "bought properties in that area knowing they had the size limitation" and warned approval would invite copycat requests. Acting chair Ralph Loftin, who walked the site, called the addition "shoehorned onto the property." Chair Paul Giotta said the plan was "substantially more detrimental" under City Code Section 650-58B. Earlier, the board continued 339 Boston Post Road to Aug. 25 pending a Conservation Commission order of conditions.
